TRIBAL

The California Tribal-State Gaming Compacts (Compact) between California Indian Tribes and the Governor of the State of California, executed in 1999, established a state certification process for determining the suitability of all Gaming Resource Suppliers/Financial Sources (Vendors) and tribal key employees to be issued a gaming license by the Tribal Gaming Agency (TGA).

The State Gaming Agency and the Tribal Government work together to develop and implement a means of regulating Class III gaming on Tribal lands to ensure the fair and honest operation of gaming in accordance with the Indian Gaming Regulatory Act. This enables the Tribe to develop self-sufficiency, promote Tribal economic development, and generate jobs and revenues to support the Tribe's government and governmental services and programs.

GAMING RESOURCE SUPPLIERS/FINANCIAL SOURCES (VENDORS)

Any Gaming Resource Supplier who, directly or indirectly, provides, has provided, or is deemed likely to provide at least twenty-five thousand dollars ($25,000) in Gaming Resources in any 12-month period, or who has received at least twenty-five thousand dollars ($25,000) in any consecutive 12-month period within the 24-month period immediately preceding application, shall be licensed by the TGA prior to the sale, lease, or distribution, or further sale, lease, or distribution, of any such Gaming Resources to or in connection with the Tribe's Operation or Facility. In addition, any person extending financing directly or indirectly to the TGA or gaming operation must be licensed by the TGA.

These Gaming Resource Suppliers and Financial Sources must request a finding of suitability from the Division of Gambling Control (Division) and submit an application to the California Gambling Control Commission (Commission) for issuance of a finding of suitability to do business with the Tribes.

TRIBAL KEY EMPLOYEES

Persons employed by California Tribal casinos in a supervisory or management capacity empowered to make discretionary decisions regarding the operation of Class III gaming activities are required to submit an application to the State Gaming Agency for a determination of suitability for licensure prior to the Gambling Control Commission's issuance of a permanent or temporary Tribal gaming license for employment as a Key Employee.
