Attorney General Lockyer Praises Appeals Court Decision Upholding National Do Not Call Registry
Says He Will Continue To Protect Californians From Invasive Telemarketers

(SACRAMENTO) – Attorney General Bill Lockyer issued the following statement on today's decision by the U.S. Tenth Circuit Court of Appeals upholding the constitutionality of the national "Do Not Call" Registry.

"The ruling is a huge victory for consumers, free choice and people's right to ensure that when they enter their homes, they do not have to endure a ceaseless cacophony of telephonic solicitations," said Lockyer. "The court properly balanced free speech concerns, and government's interest in safeguarding citizens' personal privacy and protecting consumers from telemarketing abuses.

"My office has filed two lawsuits against telemarketers for violating the federal Do Not Call restrictions. Today's ruling ensures we can continue to aggressively protect Californians' right to enjoy their homes and families free from unwanted sales pitches."

Lockyer – joined by Colorado Attorney General Ken Salazar and the Attorneys General of 44 other states, Washington D.C. and Puerto Rico – filed an amicus brief urging the appeals court to uphold the federal Registry.
